1. About these terms
These terms are between you and Apex Trade Solutions, Office No. 1 & 2, 1st Floor, Madina Center, Shahdra More, Sheikhupura Road, Lahore, Pakistan. Email apextradesolutions@hotmail.com, phone +92 370 3373689. They apply to use of this website, the customer portal, our quotes and the services we provide. By booking a service you accept them. If a signed agreement with you says something different, the signed agreement wins.
2. Our role
Apex Trade Solutions arranges and coordinates logistics as your agent. We book transport with carriers, arrange customs clearance through licensed customs agents, arrange warehousing and delivery, and inspect goods through our own auditors.
The carrier’s own transport document (bill of lading, air waybill or CMR consignment note) and the international conventions that apply to it, such as the Hague-Visby Rules, the Montreal Convention and the CMR Convention, govern the carriage itself.
3. Using this website and the portal
- Information on this website, including transit times, guides and the freight calculator, is general guidance. It is not a binding offer or legal, tax or customs advice.
- Keep your portal password private. You are responsible for activity under your account.
- Do not attempt to access data that is not yours, test the security of the site, or upload harmful files. Unauthorised access is an offence under Pakistan’s Prevention of Electronic Crimes Act 2016, and we report it.
4. Quotes
- Quotes are valid for 7 days from the date issued unless the quote states otherwise, and depend on carrier space being available when you book.
- Quotes are based on the cargo details you provide. If the actual weight, size, nature or value differs, we may re-price.
- Freight rates, surcharges (such as fuel, currency and peak-season surcharges) and exchange rates can change before shipment. We pass on carrier changes at cost and tell you before we do.
- Unless the quote lists them, quotes exclude: import duties and taxes, demurrage, detention and storage after the free time, inspections ordered by customs or other authorities, re-delivery, special handling and insurance.
5. Goods inspection before we make an offer
Before we make you an offer for goods sourced through us, our own auditors visit the supplier and inspect the goods. We share the inspection findings with you. The inspection is visual and sample-based at a point in time. It reduces risk but does not guarantee against hidden defects, and the supplier remains responsible for the quality and conformity of its goods under your purchase contract.
6. Your responsibilities
- Describe the goods accurately, including HS codes, values, weights and dimensions.
- Declare dangerous goods and provide the safety data sheet. Undeclared dangerous goods may be refused, and you are responsible for the costs and consequences.
- Provide the documents, permits and licences required for export and import, such as DRAP permits for pharmaceuticals.
- Make sure goods are packed and labelled to withstand transport.
- Make sure the goods, parties and destinations comply with export controls and sanctions.
- Pay duties, taxes and charges levied by authorities.
7. Payment
Invoices are payable within the period stated on the invoice. Duties, taxes, port and terminal charges that we pay on your behalf are payable even if the shipment is delayed or cancelled. Until our invoices are paid we may hold the goods or documents in our control (a lien) for the amount owed.
8. Cargo insurance
We do not insure your cargo unless you ask us to in writing and we confirm it. Carrier liability under international conventions is limited and often much lower than the value of the goods, so we recommend all-risk marine cargo insurance, which we can arrange through licensed insurers.
9. Our liability
- Our liability for loss of or damage to goods while in our care is limited to 2 Special Drawing Rights (SDR) per kilogram of gross weight of the goods lost or damaged, unless you declared a higher value in writing and paid the agreed extra charge.
- For delay, and for any other loss, our liability is limited to the fees we charged for the service concerned.
- We are not liable for indirect or consequential loss, such as loss of profit, market or production.
- Where a carrier, customs agent or other third party caused the loss, we will pass on to you the rights we have against them.
- Nothing in these terms limits liability that cannot be limited by law, such as liability for fraud.
10. Claims
Tell us in writing about visible loss or damage when the goods are delivered, and about hidden damage within 7 days of delivery. Claims must be brought within 9 months of delivery, or of the date the goods should have been delivered.
11. Events beyond our control
We are not responsible for delay or failure caused by events beyond our reasonable control, such as war, strikes, port congestion, extreme weather, government action, pandemics or carrier schedule changes.
12. Personal data
We handle personal data as described in our privacy policy.
13. Governing law and courts
These terms are governed by the laws of Pakistan. The courts at Lahore have exclusive jurisdiction over any dispute arising from them.
14. Changes
We may update these terms. The version in force on the date of your booking applies to that booking.
